Your Acceptance of These Terms
These Terms & Conditions form an agreement between you and Tauranga Central Computers Ltd trading as Techlord Technology (“Techlord Technology”, “we”, “us” or “our”) regarding your use of our website and your purchase of products or services from us.
By using our website, placing an order, purchasing a product, requesting a repair or using our services, you agree to comply with these Terms & Conditions as they apply to your transaction.
If you do not agree with these Terms, please do not use the website or place an order through it.
These Terms operate alongside any additional terms that may apply to a particular product, service, promotion, warranty or transaction.
Changes to These Terms
We may update these Terms & Conditions from time to time to reflect changes to our business, products, services, website or applicable legal requirements.
Updated terms will be published on this page. Changes will generally apply to future use of the website and future transactions unless otherwise required by law.
The Terms that apply to an order will be those applicable at the relevant time of the transaction, subject to any rights or obligations imposed by law.
Products, Pricing & Availability
We make reasonable efforts to ensure that product descriptions, specifications, images, prices and availability information on our website are accurate and current.
However, information may occasionally contain errors, omissions or inaccuracies. Product photographs are intended to provide a general representation and may vary slightly from the actual product.
Pricing
- Prices displayed on our website are in New Zealand dollars (NZD).
- Unless otherwise stated, displayed retail prices include New Zealand Goods and Services Tax (GST) where applicable.
- Product prices may change due to supplier pricing, exchange-rate movements, promotions, stock availability or other commercial factors.
- Where a genuine pricing or product-information error occurs, we may contact you before processing the order to clarify the correct information.
- We may limit quantities available for purchase where reasonably necessary, including promotional or limited-stock products.
If a product is unavailable after you place an order, we will communicate the situation with you and, where appropriate, provide available options including cancellation and refund.
Ordering & Formation of Contract
Placing an order
You may place an order through our website or in store by providing the information required to process the transaction, which may include your name, contact details, delivery information and payment information.
You are responsible for ensuring that the information supplied to us is accurate and complete.
Order acceptance
Submitting an order through our website is a request to purchase the selected products. An order is subject to product availability, pricing, payment verification and our ability to fulfil the order.
We may decline or cancel an order where there is a legitimate reason, such as an unavailable product, an obvious pricing error, suspected fraudulent activity, payment failure or other circumstances affecting our ability to fulfil the order.
If we cancel an order after payment has been received, we will refund the amount paid for the cancelled portion of the order, subject to any lawful rights or obligations that apply.
Payment
Payment must be completed using the payment methods made available during checkout or agreed with Techlord Technology.
Orders may not be processed until payment or payment authorisation has been successfully confirmed.
Warranty & Product Support
Techlord Technology provides product warranties according to the warranty information supplied with the relevant product. Warranty periods can vary according to whether a product is brand new, second-hand, refurbished, open-box or otherwise specified in the product listing or warranty documentation.
Brand New Products
Brand new products supplied by Techlord Technology generally include a 12-month warranty unless the applicable product documentation states otherwise.
Refurbished & Second-Hand
Warranty periods may range from 3 to 12 months depending on the product and the warranty stated on the applicable warranty documentation.
Proof of Purchase
Proof of purchase may be required when requesting warranty service.
Warranty exclusions and limitations
Warranty coverage may not apply where a problem has been caused by misuse, negligence, accidental damage, physical damage, liquid damage, unauthorised modification, unsupported hardware or software, or other circumstances outside the applicable warranty.
In particular, physical or liquid damage caused by the customer is not covered by our voluntary warranty unless otherwise stated in writing.
Like New, Open Box and Refurbished devices are not guaranteed to retain their original manufacturer water-resistance rating. Liquid damage to such devices may therefore be excluded from the applicable voluntary warranty.
Some parallel-imported mobile phones may have network or carrier features that vary by region. Customers should review the relevant product listing and compatibility information before purchasing.
Where applicable, warranty assessment and repair are generally handled through Techlord Technology or an authorised service pathway. Products may need to be returned to our store or nominated service location for assessment.
Data and backups
Customers are responsible for backing up important photographs, documents, contacts, applications and other data before handing a device to Techlord Technology for repair, warranty assessment, recovery or other service.
Repair, recovery, resetting, replacement of components or other technical work may result in loss of data. Techlord Technology cannot guarantee that data will be preserved during repair or recovery work.
Where a device cannot be safely serviced without a backup or where the requested service carries a significant risk of data loss, we may require the customer to acknowledge that risk before work proceeds.
Your Rights Under New Zealand Consumer Law
Our warranties and store policies are provided in addition to any rights you may have under applicable New Zealand consumer law.
Consumer Guarantees Act 1993
Where the Consumer Guarantees Act 1993 (CGA) applies to your purchase, it provides statutory guarantees relating to matters such as acceptable quality, fitness for purpose, matching description and other consumer guarantees.
If a product or service does not meet an applicable consumer guarantee, you may have rights to a remedy such as repair, replacement or refund depending on the circumstances and the seriousness of the problem.
Nothing in these Terms & Conditions is intended to exclude, restrict or replace any right or remedy that cannot lawfully be excluded under the CGA or other applicable New Zealand law.
The CGA generally applies to consumer purchases for personal, household or domestic use. Different rules can apply to purchases made for business purposes. Where legally permitted, business transactions may be subject to separately agreed terms.
Returns, Refunds & Change of Mind
Our Returns & Refunds Policy provides the detailed process for requesting a return, refund, replacement or other remedy.
Customers should review that policy before purchasing and contact Techlord Technology as soon as possible if there is a problem with an order.
Change-of-mind returns
Where permitted by law, a change-of-mind return is subject to our published Returns & Refunds Policy and any conditions stated for the relevant product.
This may include requirements relating to the return period, condition of the product, original packaging, accessories and proof of purchase.
Faulty products
If a product is faulty or does not meet an applicable consumer guarantee, please contact us so that we can assess the issue and provide the appropriate remedy in accordance with applicable law.
Depending on the circumstances, the remedy may include repair, replacement or refund.
Special-order products
Special-order products may have specific cancellation and return conditions that will be communicated before purchase where applicable. These conditions do not remove any non-excludable statutory rights.
Returns for Incorrectly Ordered Goods
Where we agree to accept a return for goods ordered in error or a voluntary change-of-mind return, a restocking fee may apply where permitted by law and where the applicable return conditions have been communicated.
The supplied Techlord policy specifies a restocking fee of $20 or 15% of the goods' current value, whichever is greater, for applicable returns.
Returned goods must be in saleable condition and may need to be returned with original packaging, accessories and documentation. Products that have been damaged, tampered with or otherwise altered may not qualify for a voluntary change-of-mind return.
Freight or delivery charges may not be refundable for voluntary returns where permitted by law and stated in the applicable Returns & Refunds Policy.
Important
A restocking fee does not apply to a remedy that Techlord Technology is required to provide under the Consumer Guarantees Act or another applicable law.
Dead on Arrival (DOA)
If a device appears to have a fault when first received, please contact Techlord Technology as soon as possible so that we can assess the issue.
Under our supplied store policy, a device may be treated as DOA where a fault is identified within the first two weeks after receiving the device, subject to assessment and excluding problems caused by misuse, physical damage, liquid damage or software-related issues.
Where the issue qualifies as a DOA matter, we will endeavour to resolve it through an appropriate repair or replacement depending on the nature of the fault and applicable legal requirements.
This DOA policy operates alongside, and does not limit, any rights available under applicable New Zealand consumer law.
Delivery, Shipping & Order Delays
Delivery information, available delivery methods, applicable delivery charges and estimated timeframes are provided through our Delivery & Shipping information and, where applicable, during checkout.
Delivery timeframes are estimates and may be affected by stock availability, supplier lead times, courier delays, rural delivery, public holidays or circumstances outside our reasonable control.
Damaged or missing deliveries
Customers should inspect delivered products as soon as reasonably possible and contact us promptly if an item appears damaged, incomplete or different from what was ordered.
The supplied Techlord policy requests delivery claims to be made within seven days. This administrative timeframe does not remove any statutory rights or remedies that may apply to faulty, damaged or incorrectly supplied goods.
Delivery address
Customers are responsible for providing a complete and accurate delivery address. Additional delivery charges or restrictions may apply to some locations or large-item deliveries.
Website Use & Intellectual Property
The website and its content, including text, graphics, photographs, logos, icons, layouts, software and other materials, are owned by or licensed to Techlord Technology or the relevant rights holder.
You may use the website for lawful personal or business purposes connected with researching, purchasing or using Techlord Technology products and services.
You must not copy, reproduce, modify, distribute, scrape, mirror, commercially exploit or otherwise use website content without appropriate permission, except where permitted by law.
You must not use the website for unlawful activity, to interfere with website operation, to introduce malicious software or to attempt unauthorised access to our systems.
Website Information & Errors
We aim to keep website information accurate and current. However, occasional typographical errors, product-information errors, pricing errors or availability errors may occur.
Where we identify a material error before an order is fulfilled, we may contact the customer to clarify the information or discuss available options.
We may update product specifications, descriptions, photographs, pricing, promotions and availability information as our products and suppliers change.
Nothing in this section limits statutory rights relating to products being as described or otherwise meeting applicable consumer guarantees.
Technical Support & Service Limitations
Technical support and repair services are provided according to the scope of the service agreed with the customer.
Unless otherwise agreed, support may not cover additional hardware or software installed after the original supply of a system, unsupported configurations, or issues caused by misuse or negligent use.
Where a customer requests work involving unsupported software, hardware or configurations, Techlord Technology may explain the limitations and recommend returning the system to an appropriate supported configuration before proceeding.
Out-of-warranty repairs and services may involve additional charges. Where reasonably practicable, applicable charges will be explained before the work proceeds.
Customer Information & Account Security
Information provided when ordering, contacting us or creating an account should be accurate, complete and current.
If you use an account or password-protected part of our website, you are responsible for keeping your login details confidential and notifying us if you believe your account has been compromised.
We will handle personal information in accordance with our Privacy Policy and applicable New Zealand privacy requirements.
Privacy & Personal Information
Techlord Technology collects and uses personal information where reasonably necessary to process orders, provide services, communicate with customers, arrange delivery, provide support and operate our business.
Personal information is handled in accordance with our Privacy Policy and applicable New Zealand privacy requirements.
For full information about what information we collect, why we collect it, how it may be used and the choices available to you, please refer to our dedicated Privacy Policy.
Third-Party Websites & Services
Our website may contain links to third-party websites, payment providers, manufacturers, delivery providers or other external services.
These third parties may operate under their own terms and privacy policies. Techlord Technology does not control the content or operation of third-party websites and is not responsible for their independent policies or practices.
Customers should review the applicable third-party terms before using an external service where appropriate.
Website Availability & Termination
We may update, suspend, modify or discontinue parts of the website from time to time for maintenance, security, technical or business reasons.
We may also restrict access where reasonably necessary to protect the website, our customers, our business or our systems from misuse or unauthorised activity.
Any rights or obligations that have already arisen from a completed transaction will continue to apply according to the relevant agreement and applicable law.
New Zealand Law & Dispute Resolution
These Terms & Conditions and your dealings with Techlord Technology are governed by the laws of New Zealand, subject to any mandatory rights or protections available under applicable law.
If you have a concern about a product, service or transaction, we encourage you to contact us first so that we can investigate the matter and work towards a practical resolution.
Nothing in these Terms prevents a consumer from exercising any statutory rights or pursuing a remedy available under New Zealand law.
General Provisions
If any provision of these Terms is found to be invalid, unenforceable or unlawful, that provision will be interpreted or severed to the extent necessary, while the remaining provisions will continue to operate to the extent permitted by law.
No failure or delay by Techlord Technology in enforcing a provision of these Terms will automatically constitute a waiver of that provision or any other right.
These Terms are intended to operate consistently with applicable New Zealand law.
